Hypothetical · foreign commercial award stuck in PRC recognition/enforcement
01
Scenario & challenge
Story setup: A Southeast Asia buyer obtained a foreign arbitration award (claims upheld) on an equipment sale and heard the respondent had an affiliate and possible assets in a PRC city. Internally people already said “we can enforce.” Then the file: award missing full service exhibits, arbitration “agreement” only email scans, Chinese translation unchecked, asset leads stuck at “heard there is a plant.” Respondent’s counsel teed up “no agreement,” excess of mandate, and procedural objections. Management asked how soon money could be frozen — recognition review and enforcement are two steps, and the stall points need saying before the celebration continues.
02
Possible approach
Illustrative moves: (1) Convention-aligned gap list — award originals/certificates, agreement, service and tribunal composition records, translation and authentication; (2) domicile/asset/place-of-business nexus for the right intermediate court — if weak, say so in writing; (3) preview common procedural defences and reply outlines; (4) explain recognise-then-enforce, and when preservation sits relative to enforcement; (5) turn asset rumours into a verifiable open-source plan — do not plead “heard there is a plant.” Recognition turns on statute and court review; this story presets neither a grant nor collection.
03
Limits & uncertainties
Stops at a cure plan for the dossier plus forum/defence notes for decision-makers; no recognition order, freeze, or recovery.
