Hypothetical · platform IP complaints + China TM procedure
01
Scenario & challenge
Story setup: A North American consumer brand opened on a China marketplace; core SKUs were bulk-taken down on IP complaints. The complainant showed a China trademark certificate covering the class. The brand held US/EU marks and years of use, but China filings were pending or never filed. Ops wanted an instant counter-notice to relist; legal feared the platform follows China title documents and a blunt fight would fail again. Near-copycat shops also appeared on-platform. The clock: launch calendar, ad spend, inventory. Three threads to separate — how to answer the platform, whether China title can be challenged, and whether sales should rename or pause first.
02
Possible approach
Illustrative moves: (1) pull complaint notices, title docs, and taken-down SKU lists; (2) check the complainant’s mark status (similars, assignments, opposition/invalidation windows); (3) build a platform defence pack (foreign title, prior use, licence chain) while stating the risk that the platform may keep listings down; (4) map opposition, invalidation, or other admin/civil options by evidence bar and rough timing — no promised outcome; (5) give sales a temporary naming/link plan so appeals do not amplify exposure; (6) public wording stays procedural — no “must be bad faith” claim.
03
Limits & uncertainties
Stops when a platform reply plan and China-procedure dossier outline exist; no relist, no invalidation, no win/loss.
