Hypothetical · OEM contract + China TM / unfair-competition edges
01
Scenario & challenge
Story setup: A UK brand ran multi-year OEM in South China — drawings, tooling fees, packaging design all from the brand. Domestic e-commerce then showed factory-style SKUs with a near-identical word mark and near-copied colour blocks. The factory said: domestic is another line, the mark is ours, the contract only bars “exporting the same model.” The brand’s China TM map was incomplete — core class registered, but whether trade dress qualifies as influential packaging depends on use proof. The PO was an English template; the Chinese version went soft on “no near-mark goods.” The brand needed online links stopped without triggering a supply cut or tooling hostage.
02
Possible approach
Illustrative moves: (1) map OEM/PO IP, tooling ownership, and non-compete / no-near-mark clauses — strong points vs soft wording; (2) lock live links, physical packaging, tooling payments, and design delivery proof; (3) check the factory (and affiliates) TM filings; (4) weigh cease-and-desist, platform complaints, admin leads, and civil filing in parallel, plus contract answers if supply stops or tooling is held; (5) strengthen the brand’s China mark and trade-dress evidence pack — no promised infringement finding or takedown. An OEM relationship alone does not bar the factory from its own brand — the fight sits on contract text and title.
03
Limits & uncertainties
Stops when contract/evidence mapping is done and notice/platform strategy plus a title-strengthening list are ready; no takedown, award, or settlement sum.
