Illustrative desk scene with quality inspection records and samples

This is a fictional hypothetical scenario. It does not represent an actual client, a matter handled by the firm or a result.

Hypothetical · post-arrival sampling reject and contract claim talks

01

Scenario & challenge

Story setup (not a real client): A European food-ingredient importer ordered a China-origin lot. After arrival, third-party sampling under the contract method failed a microbe limit. The factory replied on WeChat with “per contract — inspection risk is yours” and waved a pre-loading self-check pass. The buyer is stuck on three points: how many days after arrival for written objection; whether the lab stamp matches the contract’s named lab; and part of the cargo already cleared into warehouse, so return shipping is expensive. Purchasing wants a public “quality fraud” blast; legal counsel worries absolute language will hurt later claims.

02

Possible approach

Illustrative moves (no promised result): (1) map inspection, quality-objection, and risk-transfer clauses to a written-notice deadline; (2) lock sampling method, sealed-sample photos, custody notes, and the full lab report; (3) test whether the factory’s pre-load self-check can defeat an arrival third-party report; (4) structure price cut, replacement, partial return, or termination — and note how further sales affect mitigation; (5) bilingual letter with a negotiation window while keeping forum options. Evidence first, numbers later; do not sign full-and-final early.

03

Limits & uncertainties

Stops when the parties enter a written framework on test standards and disposition. No compensation ratio, no “return completed,” no judgment.
